Therefore, we immediately turn to the Government Decree of January 19, 1998, which prescribes products that cannot be exchanged or returned without good reason. Among them there are washing machines, so the rule of two weeks does not apply to them. But everything is not so bad - in reality, this restriction can be circumvented in some cases:do not make a scandal in the trading floor

  • When purchasing a car in an online store. The buyer has the right to refuse his order within 7 days after receiving the goods.

You can return with compensation only "whole" cars that have never been used and have saved all the store labels, tags and packaging elements.

  • In the absence of warranty. Check the warranty card, and if it is empty, then there is every chance of returning the machine to the seller within 2 weeks.
  • If you do not know all the information on the operation of the machine. However, the law protects not only the consumer, but also the seller. So, the store has the right to check the quality of controversial equipment with special expertise. The cost and delivery is paid by the initiator of the test, and the buyer may be present at the test.

Under the control of the consumer, an acceptance certificate is drawn up, in which the following are mandatory:

  • name of the machine, its make, serial number, year of manufacture;
  • general characteristics of the model with a listing of all available defects;
  • a detailed description of the damage (nature, size).

You can attach photographs of the washing machine from all angles to the act of acceptance for examination to exclude the substitution of results.

The check will determine whether the defect is a manufacturing defect or appeared due to the user's negligence. If the experts establish the guilt of the consumer, then he will have to compensate for the cost of the examination and pay the seller the cost of transporting the equipment to the destination.

If the equipment is taken on credit, then another side is added - the creditor bank. It should be understood that when applying for a loan for a washing machine, the latter becomes a guarantee and is considered the property of the PKU until the loan is fully repaid. Therefore, it is important to coordinate any actions with the third party to the transaction.

However, this should not prevent a return. But it is worthwhile to understand that the refund initiates the termination of only the contract of sale, while the credit remains untouched.   1. Return and termination of the contract. Returning the defective washer, the buyer has the right to early terminate the loan transaction and withdraw from itself the obligations of the pledge.
  2. Refund and prepayment. Within 30 days from the date of payment, you can apply for full early repayment, after which the store will begin to return the purchase amount directly to the consumer’s bank account. Then a statement on the absence of debt and the amount of interest paid to the creditor will be added to the list of required securities.
  3. Replacing the collateral. If a consumer wants to exchange a washing machine of inadequate quality for a model similar in cost and characteristics, the bank will go forward and amend the loan agreement. It is only necessary to provide the lender with a written statement, papers confirming the return of the equipment, and documentation for the new machine.

The main thing to remember is that in case of returning a low-quality product, the seller is obliged to bear all the costs of loans issued for it.The total amount includes the principal debt and interest accrued on it. Compensation procedure is carried out in the standard way - we apply to the PKU with a written claim, return the borrowed funds to the bank with the necessary surcharge, order all the necessary certificates (about the final cost of the loan and its early repayment) and require the store to compensate for the losses.

Seller does not contact

But not all sellers make contact with the consumer. There are companies that do not give the washing machine under warranty and issue a refund. The Directorate begins to “bustle", drag out time or completely deny the legal right to return low-quality equipment. If there is no possibility of a peaceful settlement, you will have to send a complaint to the supervisory authorities:

  • head office of the seller;
  • local branch of Rospotrebnadzor;
  • territorial branch of the Consumer Rights Protection Society;
